Judge Grants Nicole Richie Temporary Restraining Order Against Paparazzo

Nicole Richie has been granted a restraining order against a paparazzo she claims is “stalking” her and her family.

The actress, designer and mother-of-two was granted a temporary restraining order in Los Angeles Superior Court on Wednesday against Fabricio Luis Mariotto, a photographer.

In her court filing, obtained by Access Hollywood, Nicole claims that Mariotto has trespassed onto her daughter’s preschool property to take photos.

”[He] is constantly stalking my children and I at my daughter’s school, near my home and whenever we go out,” Nicole wrote in her statement to the court. “He drives erratically, endangering myself and others when he is in [pursuit] of our photographs.”

She also claims Mariotto has “left his car in the middle of a busy street” to chase down the mom and her children – Harlow and Sparrow — and that he “frightens” the children by screaming and yelling at them to “elicit a response.”

As a result of her request, the photog has been ordered to stay at least 100 yards way from Nicole, Harlow, Sparrow, and Nicole’s fiancé, Joel Madden.

Additionally, Nicole is asking the court to award her lawyer fees and costs from the photographer, in the amount of $3,355.00.

Nicole filed the request for the restraining order in Los Angeles Superior Court, also on Wednesday, through her attorney, Mark Geragos.

On Thursday, a rep for paparazzi photo agency X-17 – which is identified as the photographer’s work address in the restraining order – told Access, “the photog mentioned in Nicole Richie’s restraining order does NOT work for X-17 Online.” The rep also said they have used Mariotto as an independent contractor in the past, but said he has not worked for the angency in a long time. The rep also said they are attempting to reach Richie’s attorney to have their name removed from the restraining order.

Access was unable to reach Mariotto for comment on Thursday.
