Teri Hatcher is facing a multi-million dollar lawsuit from a cosmetics company, Access Hollywood has learned.
The suit was filed against the “Desperate Housewives” star on Tuesday in Los Angeles Superior Court on behalf of a company called Hydroderm, over what they claim is a breach of contract.
According to an attorney for the company, Hatcher had an exclusive endorsement deal with Hydroderm since 2005, when she began promoting their cosmetic and anti-aging products.
According to the lawsuit papers obtained by Access Hollywood, Hydroderm claims they entered into a contract with Hatcher in November 2005 with the understanding the actress would not use “among other things, her name, voice, autograph, image or likeness to, among other things, promote, endorse, market or adverstise skin care products manufactured or marketed by Hydroderm’s competitors.”
However, the company claims Hatcher violated the deal by endorsing a lip-plumping product produced by City Cosmetics. The lawsuit states the City product is in “direct competition” with Hydroderm’s lip enhancer.
As a result, Hydroderm is suing the actress to recoup the $2.4 million offered to Hatcher to be their celebrity endorser, as well as an additional $406,952 the company accrued in additional expenses related to the deal.
The lawsuit asks for a total of $2,806,952 from Hatcher.
When contacted by Access Hollywood, a rep for Hatcher released the following statement:
“The allegations of this lawsuit are totally false and completely without merit. Despite having to deal with a frustrating series of changes in the ownership and management of Hydroderm over the last several years,Teri Hatcher has more than fully complied with all of her contractual obligations over the course of the relationship. Clearly, Hydroderm has embarked on this unjustified and public assault on Teri Hatcher’s good name, reputation and celebrity in a transparent and pathetic effort to distract from its own failure to live up to its end of the agreement. Ms. Hatcher will respond swiftly and decisively by appropriate legal means to recover everything she is owed under her contract, as well as compensatory and punitive damages for Hydroderm’s outrageous accusations; however, she will not litigate this matter in the press, as Hydroderm apparently seeks to do.”
