LOS ANGELES, Calif. --

Following Monday’s announcement that Jon and Kate Gosselin are separating, the couple’s divorce papers surfaced on Wednesday.

According to the documents, obtained by Access Hollywood, the reality couple has “lived separate and apart for at least two years.”

According to legal experts this does not mean Jon and Kate have been separated for two years. What it does mean is that once they have been separated two years, Kate would be granted a no-fault divorce – even if Jon doesn’t want one.

According to People magazine Senior Editor Galina Espinoza, Jon and Kate told twins Cara and Mady first. Kate said that while Mady wasn’t surprised, daughter Cara broke down in tears.

When Jon and Kate told their children they were leaving each other, they didn’t ever utter the words divorce or separate.

“Kate and Jon sat down together and didn’t use the ‘D’ word for divorce or even the ‘S’ word for separated,” Galina told Access. “Basically what they said is, ‘Daddy’s not going to be here all the time.’”

According to People, Kate said the sextuplets have already shown signs of dysfunction. Collin has become quieter, while Aaden has become more sensitive.

The couple plans to keep all the kids in the same house and they will alternately spend time with them.

But according to Pennsylvania divorce expert attorney Amy Goldstein, the children may be staying in the house for custodial reasons.

“Each parent has equal time with the children so that when the case gets to the judge ultimately for custody neither party has the leg up because they have the children more,” Goldstein told Access.

And despite a report by The New York Daily News on Wednesday claiming that Jon’s alleged former mistress Deanna Hummel may make an appearance on upcoming episodes, a rep for TLC told Access, “There are no plans to use her. We are in hiatus and all future episodes haven’t even been planned.”
