“If she’s convicted, jail time would not only be appropriate, but it’ll be imperative,” Lisa insists. “This is a young woman who we’ve all seen really careening out of control and engaging in some very dangerous behavior.”
But the big question: Is Lindsay headed to jail, and if so, for how long?
“If she’s found guilty of all seven counts, the question is would the judge stack the sentences up to seven years or will they run concurrently, meaning she’ll serve less than one year,” Lisa explained. “I think she needs to learn a lesson and suffer the consequences of her actions.”
Ultimately, the fact Lindsay avoided any felony charges is a huge break – and a close call – for Lindsay, said Lisa.
“I think she got very, very lucky. The amounts of cocaine were just under the legal limit for prosecutors to charge her with a felony,” Lisa added.
Lohan’s arraignment is slated for Friday in Beverly Hills. However, there is a possibility the defense can have that date pushed up.
The 21-year-old actress, who is currently in a Utah rehab facility, will not be required to appear at the arraignment, which Bloom said was “typical” at this stage of the proceedings.
Lohan’s first DUI incident occurred on May 26, when Lohan allegedly lost control of her Mercedes and crashed into a tree near Sunset Boulevard shortly before 5:30 a.m. Although she left the scene to seek medical treatment, she later admitted to police she was the driver of the vehicle. Subsequent tests showed a substance found in her purse was .04 grams of cocaine, according to the District Attorney’s office.
The second incident was on July 24, where she was allegedly involved in a wild chase pursuing the mother of her assistant.
Shortly thereafter, Lohan checked into the Promises rehab facility – only to check out less than a month later.
In early August, she checked into the Cirque Lodge treatment center in Sundance, Utah.
And while Lindsay may be the subject of public criticism for her multiple stints in rehab, will it help or harm her case when it’s time to go before the judge?
” When Lohan agrees to go into rehab multiple times, that’s good for her,” legal analyst Royal Oakes told Access Hollywood. ” The judge will get the sense that she’s trying. But the more she fails at that, the more likely it is the judge is going to say, “You know, what we really need is some time behind bars.’”
Compounding Lindsay’s problem could be the timing of her arrests, Oakes suggested.
“The judges may be getting the sense that it’s time to end the syndrome of celebrity justice,” Oakes contended. “Lindsay Lohan may be saying to herself, ‘You know, this would have been better two or three years ago when celebrity justice seemed to be the rule.’ Now with Paris Hilton going to jail, the judges seems to be cracking down on the famous folks.
