Felony Complaint: Stern Told Doctor To Bring ‘Excessive Quantities Of Controlled Substances’ For Anna Nicole

Two years after Anna Nicole Smith’s death, her lawyer-turned-boyfriend, Howard K. Stern, and Anna’s physician, Dr. Sandeep Kapoor, surrendered late Thursday night to face charges of conspiracy to furnish her with drugs. A second physician, Dr. Khristine Eroshevich, is also accused.

Both, Stern and Kapoor were released on $20,000 bail at 9:45 PM. Anna’s personal psychiatrist, Dr. Eroshevich, is expected to surrender Monday.

“These individuals repeatedly and excessively furnished thousands of prescription pills to Anna Nicole Smith, often for no legitimate medical purpose,” California Attorney General Jerry Brown said in a statement Thursday. “This case is not a minor league case. Thousands of pills were put into the body of Anna Nicole Smith. The maximum sentence is several years, one count could be as high as three years, and there are 11 counts.”

That’s a potential of 33 years of incarceration for the three according to Brown. The charges he filed include not only the conspiracy charge, but both doctors were also charged with one count each of obtaining a prescription for opiates by fraud, deceit or misrepresentation and prescribing opiates by giving a false name or address. Additionally, all three were also charged with prescribing, or dispensing a controlled substance to an addict.

Access Hollywood obtained the shocking complaint for the arrest warrant. It alleges that Dr. Eroshevich was warned by another doctor about the dangers of Smith’s controlled substance prescriptions and that doctor recommended she be hospitalized and put on a heart monitor and admitted to rehab.

The arrest warrant also alleges that Stern told Dr. Eroshevich to bring quote “excessive quantities of controlled substances to the Bahamas for Anna Nicole Smith.”

In a statement released to Access Hollywood, a rep for Dr. Eroshevich said, “Anna was the center of a cruel tabloid feeding frenzy. In the face of this, Dr. Eroshevich did her best to help the patient while protecting what little privacy Anna had left. Any actions were done with the patient’s well-being in mind and were certainly not criminal.”

Larry Birkhead, the father of Smith’s daughter, Dannielynn, told Access, he had “no comment” on the matter.
