Gabriel Aubry Loses Bid To See Daughter Nahla

Gabriel Aubry’s attorneys returned to court on Tuesday attempting to remove the restraining order that is preventing him from seeing daughter Nahla.

According to TMZ, a judge rejected Aubry’s bid to end the order that keeps him 100 yards away from Nahla, Halle Berry and her fiancé, Olivier Martinez. The emergency temporary restraining order was issued following his fight with Martinez on Thanksgiving.

The order will end on November 29, unless Berry or Martinez return to court to attempt to extend it, the website reported.

Reps for Aubry and Berry were not available for comment when contacted by Access Hollywood on Wednesday.

In related news – previously reported on AccessHollywood.com – Aubry was granted a temporary restraining order against Martinez on Monday. Aubry claims that the actor threatened and attacked him without provocation and blames Aubry for costing him and Berry $3 million dollars.

Aubry also claims that Martinez threatened to kill him if he did not agree to move to Paris, which is what the actress and Martinez have longed to do, but Aubry has fought.

A hearing is set for December 17 to consider whether a three-year restraining order should be granted against Martinez.
