Lindsay Lohan Sentenced To 90 Days In Jail

Lindsay Lohan returned to court on Tuesday for a probation revocation hearing and was found in violation of her probation. The judge ordered the actress to 90 days in jail. She is scheduled to surrender in two weeks.

3:20 PM PST: Judge Revel orders Lindsay to jail for 90 days and 90 days in an inpatient substance abuse program for violating her probation. An emotional Lindsay begins to cry.

Lindsay is scheduled to surrender on July 20th at 8:30 AM.

3:06 PM: Lindsay addresses Judge Revel and becomes emotional.

“I wasn’t expecting any special treatment, except that I have to prove for myself,” Lindsay said through her tears. ” I did do everything that I was told to do and did… I’m not taking this as a joke, this is my life and my career… It did wake me up, it scared me.”

2:59 PM: Judge Revel finds Lindsay in violation of her probation.

2:45 PM: Lindsay’s attorney, Shawn Chapman Holley, said, “she had reason to miss the seven occasions that she did” and made up for all missed classes. She also noted that Lindsay is in compliance with the court’s order and will finish the program this month.

2:43 PM: The District Attorney prosecutor asked Judge Revel to deem Lindsay in violation of the court, saying, “The court is irrelevant to her,” reiterating that she missed seven different classes.

1:15 PM PST: Lindsay is seen returning to the courtroom – in a new outfit – after the lunch break holding a stylish blue handbag. Her younger sister, Ali Lohan, accompanies the actress.

Michael Lohan also returned to the courtroom in a new outfit.

Director of the Right On Program, Cheryl Marshall, continues to testify.

11:56 AM: Court breaks for lunch and will resume at 1:30 PM.

11: 55 AM: Director of the Right On Program, Cheryl Marshall, is asked to read out loud Lindsay’s numerous excuses for missing her alcohol education classes. The actress’ list of excuses includes: January 5 – was in North Carolina and unable to get a flight, February 24 – attending a fundraiser for Haiti and promoting a clothing line in Europe, April 14 – class rescheduled for April 15 with no excuse given, May 12 – her uncle passes away but Lindsay does not attend service, May 20 – in France for Cannes Film Festival.

11:21 PST: Director of the Right On Program, Cheryl Marshall, took the stand and said she was told over the phone by Judge Revel that Lindsay would be required to attend classes once a week, but was not given a written order by the court.

Judge Revel said, “Did you think I didn’t mean it? Did you think that the Court didn’t mean it unless a minute order followed?”

11:17: The office manager from Lindsay’s alcohol education program takes the stand, and is asked if she understood that the actress was ordered by the court to attend once a week, she said, “yes.”

10:35 AM: Judge Revel denies Michael Lohan’s request to meet in her chambers. She said she would take a letter from him.

Judge Revel decides that Lindsay’s SCRAM going off will not be addressed in court today.

District Attorney prosecutors are still reading through her alcohol education class reports, while Lindsay and her attorney wait in a conference room.

9:22 AM: The District Attorney’s office said they have witnesses who will testify that Lindsay was allegedly drinking the night her SCRAM went off following the MTV Movies Awards in June – something the actress has denied. The DA also claimed to have evidence that her alcohol-monitoring device was tampered with. Lindsay’s attorney said she was not prepared to cross-examine the witnesses, who will testify that her SCRAM was properly working.

9:16 AM: The court is taking a recess as the District Attorney and Lindsay’s attorney review the report from the actresses’ alcohol education classes.

The judge said that Lindsay’s SCRAM device going off last month could be brought up in today’s probation violation hearing. Judge Revel said, “I just had somebody wear the SCRAM for a year and it didn’t go off once. It’s remarkable that it went off within two weeks of her having it on.”

8:55 AM: Judge Revel clears her calendar, moving all of her other cases to allow time for Lindsay’s case, which is expected to last at least half the day as witnesses are called to the stand in order to determine if the actress has violated her probation

8:49 AM: Lindsay arrives on time and the hearing begins. The actress does not acknowledge her father who is seated in the front row of the courtroom. Michael looks in Lindsay’s direction multiple times, but she does not face him.

Judge Marsha Revel orders Lindsay’s alcohol education program to turn over the actress’ reports after the District Attorney said they were not given the documents due to privacy.

Judge Revel then reviews Lindsay’s reports.

8:18 AM: Lindsay Lohan arrives at the Beverly Hills courthouse in a black SUV with her attorney Shawn Chapman Holley. Lindsay is wearing a fitted black blouse and dark slacks.

8:11 AM: Lindsay’s father, Michael Lohan is seen arriving at the courthouse.

As previously reported on AccessHollywood.com, according to the Associated Press, Tuesday’s hearing will likely include testimony and evidence about the 24-year-old’s ongoing progress with her probation. Los Angeles County district attorney spokeswoman Sandi Gibbons told the AP that the prosecutor in the case could still decide not to seek jail time for Lindsay. If the actress is sent to jail by the judge, she will be taken into custody immediately.

The AP also reported that if Lindsay avoids jail, she could also possibly get to remove her SCRAM alcohol-monitoring device that she has had to wear around her ankle since May.
