Nick Loeb Suing Sofia Vergara Over Frozen Embryos

Nick Loeb has filed a petition to stop his former fiancée, Sofia Vergara, from destroying embryos the former couple froze before splitting.

The couple created (through in vitro fertilization) and froze the embryos six months before calling it quits in May 2014.

According to court documents, the couple indicated that should either partner die, the embryos would be thawed and destroyed. However, there was nothing indicating the fate of the embryos if the couple separated.

Now that the two have gone their separate ways, Nick would still like to have the two remaining female embryos kept frozen, while he says Sofia does not want to keep them.

“I offered Sofia the option to not destroy them and I offered to waive all parental and financial responsibility and she said she didn’t care and would rather destroy them,” Nick said in an exclusive statement to Access Hollywood’s Billy Bush on Wednesday night.

Access Hollywood has reached out to a rep for Sofia for comment on Nick’s claim.

Nick and Sofia got engaged during a trip to Mexico in July 2012, while celebrating the actress’ 40th birthday. They began dating in 2010.

Two months after their split, the “Modern Family” beauty was linked to “Magic Mike” star Joe Manganiello.

Sofia and Joe got engaged on Christmas Day 2014 in Hawaii.
