Nicole Richie’s day in court won’t be today. The hearing for which she’s seeking a permanent restraining order against a paparazzo has been continued to December 21.
Richie’s attorney, Mark Geragos, who was present in court today with two witnesses, confirmed the news of the continuance.
Access Hollywood was in the courtroom this morning and spoke with Fabricio Luis Mariotto, the photographer against whom Richie is seeking the permanent restraining order. Mariotto showed up in court today without an attorney and with a few magazines in hand.
“The building doesn’t look like a school from the outside,” he explained to Access producer Selin Darkalstanian. He claimed that since he was so focused on taking a clear photo, he hadn’t looked around. He further claimed that as soon as he realized it was a school, he left.
After the continuance, Access spoke further outside of the courtroom with the 32-year-old Mariotto, who said that he is indeed representing himself. He claimed that the place from which he took photos was not private property and that he was never being disrespectful. He further claimed that he had been to Harlow Richie’s (Nicole’s daughter’s) school only once and that as soon as he realized it was a school, he never went back. He claimed that he hasn’t taken a photo of Nicole for eight months and that she makes up 0.01 percent of his income (most of which, he claimed, comes from celebrities such as Brad and Angelina, and Reese Witherspoon). He said he agrees that paparazzi should not be at a school. He claimed that he does not work for the photo agency X17, and that he is an independent photographer. Mariotto said he wants the temporary restraining order currently in place against him dismissed.
Richie was granted a temporary restraining order against Mariotto on November 11.
