No Jail Time For Mel As Gibson Cuts Deal Over Blow Up With Oksana

Mel Gibson won’t be headed to jail for his alleged blow up with ex-girlfriend Oksana Grigorieva that made headlines last year.

A source told Access Hollywood that Gibson – through his attorney Blair Berk — has reached an agreement with prosecutors and made a plea deal in the case.

According to an Associated Press source, Gibson will be charged with misdemeanor battery over the incident, which occurred in January 2010.

In a statement to Access Hollywood, Berk explained why the actor accepted a plea deal.

“I know from almost 20 years as a criminal defense lawyer that sometimes justice can come for a client at too high a personal price. That is particularly so for Mel, whose right to due process can only be exercised in this case with an enormous media circus attached,” the statement noted. “Mel’s priority throughout all of this has been that the best interests of his young daughter Lucia and the rest of his children be put first in any decisions made. It is with only that in mind that he asked me to approach the District Attorney with a proposal that would bring all of this to an immediate end.”

TMZ, which first reported the story, claims Gibson will plead “no contest” to simple battery and will receive counseling over the incident.

Gibson is alleged to have struck Grigorieva during the incident, but she did not report it for months.

Gibson and Grigorieva are parents to a daughter, Lucia, who was born in 2009.

In related news, just weeks ago, detectives turned over the results of their extortion investigation into Grigorieva, but no announcement has been made on whether the district attorney’s office will prosecute.

Authorities began investigating the Russian singer in July 2010. She was alleged to have attempted to extort Gibson as they dealt with issues related to their child.
