Sofia Vergara Breaks Silence On Frozen Embryo Battle With Nick Loeb

Sofia Vergara has spoken out about former fiance Nick Loeb filing a petition to stop her from destroying embryos the former couple froze before splitting.

“There is a contract that he can’t do anything,” the actress told Howard Stern on his SiriusXM radio show on Monday. “We wrote what we wanted at the time. It’s not like a contract [where] they give [it to] you right there the moment they’re gonna take the eggs out — no, they give you this in advance. You see it, you review it, and not only that, we did it two times. … Two times and suddenly you want to change your mind?”

The “Hot Pursuit” star explained that she can’t imagine a court ruling in Loeb’s favor.

“What judge is going to say OK?” she told Howard. “Even if it’s life or not life, it’s not what he signed at the moment. You know, you should have thought about all of that.”

The actress, who is now engaged to Joe Manganiello, questions what kind of environment it would be for a child with two parents who are not on the best terms.

“More than a mother, [a child] needs a loving relationship of parents that you know, get along, that don’t hate each other,” she explained. “I don’t hate him but obviously he has a problem with me. … I wouldn’t imagine anyone saying to bring to the world kids that already have everything set up wrong for them. It’d be so selfish.”

Access has reached out to Loeb for comment.

As previously reported on AccessHollywood.com, the former couple created (through in vitro fertilization) and froze the embryos six months before calling it quits in May 2014.

According to court documents, in the contract with the fertility clinic the couple indicated that should either partner die, the embryos would be thawed and destroyed. However, there was nothing indicating the fate of the embryos if the couple separated. Nick claims this omission makes the agreement invalid because California law requires clinic contracts to state what should happen to the embryos if the couple splits.

Now that the two have gone their separate ways, Nick would still like to have the two remaining female embryos kept frozen, while he says Sofia does not want to keep them.

“I offered Sofia the option to not destroy them and I offered to waive all parental and financial responsibility and she said she didn’t care and would rather destroy them,” Nick said in an exclusive statement to Access Hollywood’s Billy Bush last month.
