UPDATE: Christina Aguilera Arrested For Intoxication, No Charges Will Be Filed; Boyfriend Also Arrested

Christina Aguilera was arrested and detained for public intoxication early Tuesday, but the singer will not be prosecuted, Access Hollywood has confirmed. Aguilera’s boyfriend, Matthew Rutler, was also arrested for allegedly driving under the influence.

“At 2:45 AM Los Angeles Sheriff’s Department Deputies assigned to West Hollywood station conducted a traffic stop in the 1100 block of Clark Street, West Hollywood, regarding a Drunk Driving investigation. The driver, Matthew Rutler, was determined to be driving while under the influence of alcohol and arrested,” a spokesperson for the Los Angeles Sheriff’s Department said in a statement to Access.

“Christina Aguilera was the passenger in the vehicle. Deputies determined Aguilera was intoxicated. Since she was not able to care for her safety and no one was available to ensure her safety, Aguilera was taken into custody,” the statement continued. “Sheriff’s Department officials stressed that she was not involved in any criminal activity and will be released when she can safely care for herself.”

On Tuesday morning, Los Angeles Sheriff’s Department spokesperson Steve Whitmore explained why the singer will not be prosecuted.

“Technically there is an arrest,” Whitmore said during a press conference. “It will be on her record. She will have a record of a misdemeanor public intoxication arrest, however the law specifically allows for no desire to prosecute whatsoever. She didn’t get a court date. So, if you will, when people say detained, arrested – technically it’s an arrest, but from the very beginning there was never the intent to prosecute.”

According to Rutler’s booking sheet, he is being held on $5,000 bail.

Aguilera’s rep was not immediately available for comment when contacted by Access on Tuesday morning.
